Resumen
El derecho civil francés, tradicionalmente fundado en la noción material de guarda consagrada por la sentencia Franck de 1941, muestra, en realidad, una tendencia jurisprudencial a hacer coincidir la responsabilidad con la propiedad. El propietario sigue siendo considerado responsable aun cuando ha perdido el control material de la cosa, y se le atribuye responsabilidad, incluso por cosas sobre las que, teóricamente, no ejerce derecho alguno, como la res nullius, los animales salvajes o los residuos. Esta evolución se justifica mediante la teoría del riesgo y la lógica del seguro. El trabajo analiza las manifestaciones prácticas y las justificaciones teóricas de esta responsabilidad sin guarda, así como la extensión de la responsabilidad más allá de las fronteras de la propiedad. Se concluye señalando la dificultad creciente del propietario para abdicar de su propiedad, lo que conduce a reconocer un verdadero deber de propiedad.
Abstract
French civil law, traditionally founded on the material conception of custody established by the 1941 Franck decision, in fact shows a jurisprudential trend linking liability with ownership. The owner remains liable even after losing material control of the thing, and may be held responsible for things over which, theorically, he exercises no property right, such as res nullius, wild animals, or waste. This evolution is justified through the risk theory and the logic of insurance. The article analyzes the practical manifestations and theoretical justifications of this liability without custody, as well as the extension of liability beyond the boundaries of ownership. It concludes by highlighting the owner’s growing difficulty in abdicating property, which leads to the recognition of a genuine duty of ownership.
