Para abordar los desafíos que la inteligencia artificial (IA) plantea en el ámbito del derecho de daños, es fundamental analizar la posible aplicación de las reglas de responsabilidad civil existentes ante los perjuicios ocasionados por los sistemas operados con IA. Este artículo examina las limitaciones de los conceptos legales tradicionales frente a la autonomía y las capacidades de autoaprendizaje de estas tecnologías, cuestionando si las normativas actuales son suficientes para manejar las complejidades introducidas por los sistemas inteligentes.
Abstract
To address the challenges that artificial intelligence (AI) poses in the field of tort law, it is essential to analyze the applicability of existing civil liability frameworks to the damages caused by AI-operated systems. This article examines the limitations of traditional legal concepts in the face of the autonomy and self-learning capabilities of these technologies, questioning whether current regulations are sufficient to manage the complexities introduced by intelligent systems.
