La consagración del derecho de imagen -y sus vertientes- en la legislación española y la situación actual en la legislación chilena

Resumen

El presente artículo pretende informar al lector que el derecho de imagen cuenta con dos vertientes: La primera, denominada “positiva”, que consiste en la comercialización del derecho y la segunda, denominada “negativa”, que consiste en la prohibición de intromisiones ilegitimas de la imagen de las personas. Ambas vertientes recaen sobre la persona, pero sus alcances y efectos son diversos; se analizarán a través de conocidas jurisprudencias que serán ilustrativas –y entretenidas– para el lector. Junto con lo anterior, se analizará la completa reglamentación que actualmente existe de este derecho en la legislación española con la precaria reglamentación en la legislación chilena.

Abstract

This article aims to inform the reader that the Image Right has two aspects, the first, called “positive” which consists of the commercialization of the right and the second, called “negative” which consists of the prohibition of illegitimate interference of the image of people. Both aspects fall on the person, but their scope and effects are diverse; The slopes will be analyzed through well-known jurisprudence that will be illustrative –and entertaining– for the reader. Along with the above, the complete regulation that currently exists of this right in Spanish legislation with the precarious regulation in Chilean legislation will be analyzed.
