El artículo presenta el sistema de solución de controversias internacionales establecido en el capítulo xx del CPTPP y que es distinto y separado del sistema general de solución de controversias internacionales del CPTPP y que conforma la totalidad del capítulo xxvIII del CPTPP. El texto se estructura considerando las siguientes secciones: a. Instituciones y funcionamiento, b. Sistema. Junto con explicar cada una de las partes del sistema y su funcionamiento y operatividad, se proponen algunas consideraciones que intentan explicar las razones por la opción de agregar este sistema específico de solución de disputas ambientales en forma adicional al sistema general. En términos globales, las razones detrás de esta decisión se encuentran en la especial na- turaleza de los temas ambientales y la creciente relevancia de estos temas en su relación con el comercio internacional.

These notes present the international dispute settlement system established in Chapter xx of the CPTPP, which is distinct and separate from the general international dispute settlement system of the CPTPP and which makes up the entirety of Chapter xxvIII of the CPTPP. The text is structured considering the following sections: a. Institutions and operation. b. Consultation system. c. Dispute settlement system itself. Along with explaining each of the parts of the system and its functioning and operation, some considerations are raised that try to explain the reasons why it was decided to add this specific environmental dispute settlement system in addition to the general system. In global terms, it is argued that the reasons behind this decision are to be found in the special nature of environmental issues and the growing relevance of these issues in relation to international trade.
