El presente texto tiene por objetivo analizar la garantía del debido proceso de cara al proceso constituyente que puede tener lugar después del plebiscito del 25 de octubre de 2020. Si bien existe un listado de derechos o garantías judiciales que la Constitución asegura a todas las personas, ese listado podría completarse integrando algunos otros que también se consideren esen- ciales. Esta posible incorporación de derechos y garantías puede considerarse bien intencionada, pero no solucionará los problemas que enfrenta el sistema de administración de justicia. En otras palabras, consideramos que antes de la incorporación de ciertos derechos a la noción o contenido del debido proceso los operadores jurídicos y también el legislador deben hacer una reflexión con respecto a cuáles son las causas que producen problemas y una posible conculcación de ciertos derechos o garantías judiciales.
A continuación, aludiremos al reconocimiento constitucional de di- cho principio legal, a los derechos que componen este concepto jurídico indeterminado y a algunos de los mecanismos judiciales que tienen por ob- jetivo la protección de este derecho.

The purpose of this text is to analyze the guarantee of due process in the face of the constituent process that may take place after the plebiscite of October 25, 2020. Although there is a list of rights or judicial guarantees that the Constitution ensures to all people, This list could be completed by integrating some others that are also considered essential. This possible incorporation of rights and guarantees may be considered well-intentioned, but it will not solve the problems facing the justice administration system. In other words, we consider that before the incorporation of certain rights to the notion or content of due process, legal operators and also the legislator should reflect on what are the causes that produce problems and a possible infringement of certain rights or judicial guarantees.
Next, we will refer to the constitutional recognition of said legal prin- ciple, to the rights that make up this indeterminate legal concept and to some of the judicial mechanisms that aim to protect this right.
