Ante la creciente automatización del mundo, todavía es posible evaluar la real conveniencia y necesidad de incorporar herramientas de inteligencia artificial (IA) en el proceso judicial. Aún estamos a tiempo de impedir que la IA imponga su ley, “orientando desde las alturas de su autoridad, los asuntos humanos”; entre ellos, los vinculados a la solución de los conflictos. Esta elección repercute, en última instancia, en el tipo de sociedad en que queremos vivir. En atención a lo anterior, en este trabajo se ofrecen algunas consideraciones o prevenciones que pueden ser útiles al momento de evaluar la eventual incorporación de herramientas o sistemas de IA en el proceso judicial, mediante ciertos lineamientos o consideraciones básicas a tener en cuenta.

Given the growing automation of the world, it is still possible to assess the actual convenience and necessity of incorporating artificial intelligence (AI) tools into the judicial process. We still have time to prevent AI from imposing its law, “guiding human affairs from the heights of its authority,” including those related to conflict resolution. This choice ultimately shapes the type of society in which we want to live. In light of the above, this work presents some considerations and precautions that may be useful when evaluating the potential integration of AI tools or systems into the judicial process, providing key guidelines and fundamental aspects to take into account.
