Alcances del concepto de “no deliberantes” de las Fuerzas Armadas y Carabineros
Resumen
La característica de no deliberantes, aplicables a las Fuerzas Armadas y Carabineros, se incorpora en los primeros textos constitucionales chilenos del siglo xix. Sin embargo, ha sido objeto de interpretaciones diversas. Este artículo postula que la citada característica, que debiera mantenerse en la futura Constitución, debe entenderse asociada a la obediencia que dichos órganos del Estado deben mantener respecto del orden institucional de la república y no de personas o autoridades determinadas.
Abstract
The characteristic of non-deliberative, applicable to the Armed Forces and Policy, is incorporated in the first Chilean constitutional texts of the nineteenth century. However, it has been subject of different interpretations. This article postulates that the aforementioned characteristic, which should be maintained in the future Constitution, should be understood as associated with the obedience that these organs of the State must maintain with respect to the institutional order of the Republic and not of specific persons or authorities.
