El artículo analiza el concepto de fraude constitucional, desde sus orígenes, en el constitucionalismo clásico del siglo XIX, hasta su aplicación en el Estado de Chile. Se estudian los primeros casos bajo la vigencia de la Constitución de 1833, con especial atención en la ley de tolerancia o libertad de cultos de 1865 y la república parlamentaria, luego, los sucesos de fraude bajo la Carta de 1925, el Congreso Termal, las leyes de reforma agraria y nacionalización de la gran minería del cobre, para pasar breve revista al actual cambio constitucional chileno desde 2019 en adelante.

The article analyzes the concept of constitutional fraud, from its origins, in the classic constitutionalism of the 19th century, to its application in the State of Chile. The first cases are studied under the validity of the Constitution of 1833, with special attention to the law of tolerance or freedom of religion of 1865 and the parliamentary republic, then the events of fraud under the Constitution of 1925, the Thermal Congress, the agrarian reform laws and nationalization of great copper mining, to briefly review the current Chilean constitutional change from 2019 onwards.
