Una mirada en retrospectiva del artículo 2331 del Código Civil para la actualidad
Resumen
El presente trabajo es un estudio histórico-dogmático sobre el artículo 2331 del Código Civil. Se ha entendido generalmente que este artículo es original de Andrés Bello por no encontrar una disposición parecida en el Code Napoleón o en las Siete Partidas. Sin embargo, no estamos completamente de acuerdo con ello, pues creemos que existen otras fuentes o filosofías jurídicas que llevaron al jurista a establecer el artículo en comento, las cuales pretendemos. Por ende, en este trabajo trataremos de identificar esas fuentes y con ello contribuir en parte al entendimiento histórico-jurídico de este polémico artículo, declarado en más de una ocasión inaplicable por el Tribunal Constitucional y sobre el cual el mismo analizó su inconstitucionalidad.
Abstract
The present paper consists of a research with a historic-dogmatic character about article 2331 of the Chilean Civil Code. It has been generally understood that the wording of this article is one of Andres Bello’s original pieces as no such an article or similar provisions are to be found neither in the Code Napoleón nor in the Siete Partidas. However this might not be totally accurate as it is believed that other legal or philosophical sources might have influenced Bello on his creation of article 2331 of the Chilean Civil Code.
