La titularidad sindical fue el principio rector para la nueva regulación en materia de Derecho Colectivo del Trabajo, la cual en un control preventivo fue declarada inconstitucional por parte del Tribunal Constitucional, eliminando, por ende, del proyecto de ley una serie de disposiciones relativas a la materia. Pese lo anterior, en la nueva normativa subsisten ciertos resabios de titularidad sindical que afectan directa e indirecta las libertades y derechos de que son titulares individualmente, independiente de su afiliación sindical, las cuales deben ser consideradas y corregidas vía legal o jurisprudencial.

Trade union’s ownership was the guiding principle for the new regulation regarding collective labor law. However, in the exercise of its preventive control over new legislation, the Constitutional Court declared the unconstitutionality of this principle. As a result, a set of rules regarding the matter had to be eliminated from the regulation. Notwithstanding, some traces of trade union’s ownership survive in the new regulation. These affect the rights and freedoms workers have individually, regardless of their union membership, and should be considered and corrected either by the law or the judiciary.
