“Smart Contracts”: Origen, aplicación y principales desafíos en el derecho contractual Chileno
Resumen
Los denominados “smart contracts” son una innovación tecnológica que, valiéndose de la tecnología Blockchain, permite realizar transacciones deforma segura, expedita y casi sin riesgo de incumplimientos contractuales. Sin embargo, no está del todo claro si estos instrumentos constituyen jurídicamente “contratos”, y si, por consiguiente, han de aplicarle todas las normas y estructuras propias de un contrato, de conformidad con la legislación chilena.
Abstract
Smart contracts are a technological innovation which, using the features of the Blockchain technology, allow transactions to be executed and performed in a safe and unobstructed way, and with almost no risk of eventual breaches. However, there is no certainty about whether smart contracts are actually legally agreements and if, therefore, they should be subject to all the regulations and structures related to contracts, in accordance to Chilean law.
