Importantes reformas han modernizado el Derecho Civil francés en los últimos años. La próxima se pronunciará sobre los pilares fundamentales de la responsabilidad civil, y nuestro objetivo es difundirla. El deber de mitigar el daño, el reconocimiento de la “cesación del ilícito” a título de manifestación de la función preventiva del instituto resarcitorio, la consagración de la función punitiva de la responsabilidad, la exclusión de la exoneración por vía de riesgos del desarrollo cuando el daño proviene de un elemento del cuerpo humano o por productos obtenidos de aquel, o por todo producto de salud destinado al uso humano, normas relativas a la indemnización del daño corporal, a la pérdida de chance, a los daños ecológicos, o a la causalidad difusa, constituyen solo algunas de las materias en las que se verificará esta mise à jour o actualización del derecho francés en el ámbito ya indicado.

The duty to mitigate the damage, the recognition of the “cessation of the offense” as a manifestation of the preventive function of the compensatory institute, the consecration of the punitive function of responsibility, the exclusion of exoneration by way of development risks when the damage comes from an element of the human body or by products obtained from it, or by any health product intended for human use, norms relating to the compensation of bodily harm, loss of chance, ecological damage, or causality diffuse, they are only some of the subjects in which this mise à jour or French law update will be verified in the field already indicated.
