Los derechos de aprovechamiento de aguas son el título por el cual se permite el uso de un cierto caudal de aguas terrestres, que se permite extraer de fuentes naturales. Por regla general, el caudal establecido en el derecho de aprovechamiento es un elemento esencial que fija el máximo que el titular puede utilizar. Una menor cantidad de agua disponible puede determinar que los usuarios tengan que disminuir el volumen a extraer, dentro del ejercicio normal del derecho. Pero adicionalmente, en el nuevo Código de Aguas existen una serie de situaciones en las que la autoridad puede restringir el volumen que los titulares de los derechos de aprovechamiento pueden utilizar. Este trabajo busca analizar estas medidas, proponiendo una sistematización de ellas, identificando su justificación, efectos y características.

Water rights are the title which authorizes the use of a certain volume of water extracted from natural sources. In general, the volume established in the water right is an essential element that fixes the maximum volume of extraction. A lower quantity of available water may determine that the users have to diminish the volume to extract, within the normal exercise of the water right. But additionally, the new Chilean Water Code considers a serious of situations in which the authority may curtail the authorized volume of the water rights. This work seeks to analyze these measures, proposing a systematization of them identifying their justification, effects and characteristics.
