Ley n.º 21400, modifica diversos cuerpos legales para regular, en igualdad de condiciones, el matrimonio entre personas del mismo sexo
Resumen
La definición de la institución del matrimonio vigente hasta marzo del presente año en nuestra legislación, pertenece a la normativa original del Código Civil aprobada el año 18551 . Esta disposición no había sufrido modificación sino hasta ahora, con la entrada en vigencia de la Ley n.º 214002 ; transformando a Chile en el vigésimo quinto país del mundo en reconocer oficialmente el vínculo marital entre personas del mismo sexo. Es, en este contexto, que dicha ley introduce una serie de modificaciones al Código Civil y otros cuerpos legales, necesarias para permitir el matrimonio de parejas del mismo sexo y regular los derechos y obligaciones que surgirán para quienes lo celebren.
Abstract
The definition of the institution of marriage in force until March of this year in our legislation, belongs to the original regulations of the Civil Code approved in 1855. This provision had not been modified until now, with the entry into force of the Law #21400; transforming Chile into the twentyfifth country in the world to officially recognize the marital bond between people of the same sex. It is, in this context, that said law introduces a series of modifications to the Civil Code and other legal bodies, necessary to allow the marriage of same-sex couples and regulate the rights and obligations that will arise for those who celebrate it.
