La reciente jurisprudencia del Tribunal Constitucional en materia de libre competencia

Resumen

Se describe la última jurisprudencia contenida en las sentencias de inaplicabilidad del Tribunal Constitucional chileno, recaídas sobre requerimientos que impugnan preceptos contenidos en el decreto ley n.° 211, que fija normas para la Defensa de la Libre Competencia, o que se aplican con ocasión de tal cuerpo normativo. De los fallos se extraen criterios que permiten a los distintos operadores del derecho tener un panorama general y actualizado sobre esta materia.

Abstract

The purpose of this paper is to describe the latest jurisprudence contained in the judgments of the Chilean Constitutional Court. Specifically, we have selected those judgments of inapplicability that have been handed down on injunctions challenging precepts contained in Decree Law No. 211, which sets rules for antitrust matters, or that are applied on the occasion of such normative body.The rulings are analyzed by extracting criteria that allow the different operators of the law to have a general and updated overview on this matter.
