La prescripción extintiva en el Derecho Civil Chileno y Español: revaluación de criterios doctrinales y propuestas
Resumen
El presente trabajo aborda diversos criterios normativos y jurídicos de la prescripción extintiva general, centrando su mirada en la legislación chilena y española como cuerpos legales para analizar el contenido general de la prescripción en ambos países y establecer comparaciones analíticas y criterios de evaluación mediante el cotejamiento de ambos cuerpos normativos y doctrinales. Finalmente, se pretende entregar al lector una reevaluación de ciertos aspectos de la institución chilena de prescripción extintiva tradicional, entregando un criterio doctrinal moderno para futuros cambios o reformas legislativas a considerar.
Abstract
The present work addresses various normative and legal criteria of the general extinctive prescription, focusing its attention on the Chilean and Spanish legislation as legal bodies to analyze the general content of the prescription in both countries and establish analytical comparisons and evaluation criteria through the collation of both normative and doctrinal bodies. Finally, it is intended to give the reader a reassessment of certain aspects of the Chilean institution of traditional extinction prescription, providing a modern doctrinal criterion for future changes or legislative reforms to consider.
