El artículo estudia la larga tradición en materia de libertad de enseñanza que exhibe la historia institucional y política chilena. Desde antes de la misma República, la libertad de enseñanza ha sido uno de los pilares del sistema educativo nacional. Se examina la libertad de enseñanza en la monarquía hispánica, la república decimonónica, con especial énfasis en las discusiones entre conservadores ultramontanos y liberales, que se plasmaron en la reforma constitucional de 1874. Luego, se revisa el cambio de siglo con los intentos por consagrar un “Estado docente” y la consagración expresa del sistema de libertades que nos rige y los tratados y declaraciones internacionales suscritos por Chile.

The article studies the long tradition in terms of freedom of education exhibited by Chilean institutional and political history. Since before the republic itself, freedom of education has been one of the pillars of the national educational system. Freedom of education in the Hispanic Monarchy, the nineteenth-century republic, is examined, with special emphasis on the discussions between ultramontane conservatives and liberals, which resulted in the constitutional reform of 1874. Then, the turn of the century is reviewed with the attempts to consecrate a “Teaching State” and the express consecration of the system of freedoms that governs us and the international treaties and declarations signed by Chile.
