El texto entrega sugerencias para la regulación de la igualdad en la nueva Constitución. Considerando la equivocidad y vacuidad de la igualdad, sugerimos complementar la noción tradicional y explicitar su vinculación a la dignidad. Luego, invitamos a conservar la proclamación fundamental de igualdad entre los seres humanos, así como la fórmula general antidiscriminatoria por su amplitud y flexibilidad, y la protección de la igualdad en forma autónoma y no parasitaria a otro derecho. Proponemos, también, incluir la multidiscriminación y la acomodación razonable, y más controversialmente, la discriminación positiva y la discriminación entre privados. Finalmente formulamos algunas advertencias.

This work provides some hints on how to the new constitution should deal with equality. Considering its multiple meanings and its vacuity, the traditional notion of equality should be supplemented and its link with dignity expressed. The fundamental proclamation of equality between human beings should be preserved, as well as the general antidiscrimination formula because of its broad scope and flexibility, and also the protection of equality as a right on its own. It also suggests the inclusion of multidiscrimination and reasonable accommodation, and more controversially, affirmative action and private discrimination. Finally, it advances some warnings.
