El presente trabajo estudia el papel que pueden representar los derechos humanos frente al ejercicio del poder constituyente, en el marco del proceso chileno de elaboración de una nueva Constitución. Se revisan las concepciones clásicas de poder constituyente, así como las doctrinas que analizan si este tiene límites o no. Luego, se postula que los derechos humanos forman parte esencial de la identidad del pueblo chileno, representando un contenido esencial e indisponible para el poder constituyente. Finalmente, se elaboran alguna propuestas destinadas a instaurar un estatuto más favorable a la garantía de los derechos humanos en la nueva Constitución.

This paper studies the role that human rights could play in the exercise of the constituent power, within the framework of the Chilean process to draft a New Constitution. It reviews the classical concepts of constituent power, as well as the doctrines that analyze whether it has limits or not. Then, it argues that human rights are an essential part of the identity of the Chilean people, representing an essential and indisposable content for the constituent power. Finally, some propositions are outlined to establish a statute more favorable to the guarantee of human rights in the New Constitution.
