Hipoteca sobre concesiones de acuicultura de salmónidos
Resumen
El presente artículo aborda un tema escasamente tratado en la doctrina chilena, cual es la constitución de hipoteca sobre una concesión de acuicultura de salmones. En él, se trata la naturaleza jurídica de esta garantía, la normativa aplicable, a qué se extiende esta hipoteca, la caducidad de las concesiones y la forma en que se constituye la hipoteca. Finalmente, se analiza la legislación noruega, principal competidor de Chile en la industria del salmón.
Abstract
This article deals with a subject scarcely dealt with in Chilean doctrine, which is the constitution of a mortgage on a salmon aquaculture concession. It deals with the legal nature of this guarantee, the applicable regulations, the scope of this mortgage, the expiration of the concessions and the way in which the mortgage is constituted. Finally, it deals with the Norwegian legislation, Chile’s main competitor in the salmon industry.
