El Estado de derecho es un principio cuyos deslindes son difíciles de determinar pese a ser considerado un pilar de la democracia constitucional. Por esto, la presente investigación busca entregar elementos que ayuden a la comprensión de este concepto plástico mediante una revisión de tres perspectivas: el origen histórico del concepto de Estado de derecho; luego un repaso de sus diversos contenidos y, finalmente, un examen a la aplicación dispar que ha tenido la noción de Estado de derecho en diversos ámbitos, entre los que se incluyen las altas cortes de Estados Unidos y de Chile. El trabajo finaliza con algunas luces para la concreción del concepto en nuestro derecho.

The concept of the rule of law is as ambiguous as relevant. While it is complex to identify what it encompasses, the rule of law is considered one of the pillars of constitutional democracy. This essay intends to give meaning to it through three different perspectives—a brief examination of its historical origins, a review of diverse contents associated with it, and an analysis of case laws. This essay highlights the dissimilarities of the rule of law concept in its application by comparing the High Courts of the United States with the courts in Chile. It finishes with suggestions for the concretion of the concept.
