El derecho a la tramitación (Ius ut procedatur) como un derecho subjetivo del Convencional constituyente

Resumen

El juego de mayorías y minorías en toda asamblea legislativa exige el reconocimiento y protección de ciertos derechos sin los cuales el ejercicio efectivo del cargo confiado por el cuerpo electoral quedaría vacío de contenido. Esta afirmación cobra mayor relevancia en el funcionamiento del órgano encargado de la elaboración de una nueva Constitución, donde se impone como esencial el derecho a la tramitación de todos los documentos que contengan propuestas normativas, impidiendo que puedan ser descartados sin previo debate. Esta prerrogativa debe ser consagrada en el Reglamento de la Convención Constitucional y garantizada mediante la posibilidad de reclamar ante su transgresión.

Abstract

In every legislative assembly the fair interplay between majorities and minorities requires the recognition and protection of certain rights in order to guarantee the effective exercise of the task entrusted by the electorate. This statement becomes more relevant in the functioning of the body in charge of drafting a new Constitution, where the right to proceed with all documents containing regulatory proposals is essential, therefore preventing them from being arbitrarily rejected without prior debate. This prerogative must be established in the Constitutional Convention Rules of Procedure and guaranteed by the possibility of claiming against its transgression.
