Derecho forestal y la regulación ambiental de los bosques
Resumen
El presente trabajo tiene por objetivo entregar lineamientos respecto del vínculo jurídico existente entre el derecho forestal y el derecho ambiental, junto con indicar los mecanismos contemplados en la legislación chilena para brindar una debida protección a los bosques y recursos forestales. Para estos efectos, describirá el contexto histórico y principales cuerpos jurídicos que conforman el derecho forestal, para luego abordar los instrumentos que contempla el ordenamiento jurídico chileno para velar por el uso sustentable del recurso forestal.
Abstract
The purpose of this work is to provide guidelines about the relationship that exists between the Forest Law and the Environmental Law, together with indicating the mechanisms contemplated in the Chilean legislation to provide due protection to native forest. For these purposes, we will provide a historical background and framework of forest law. In addition, we will analyze the instruments contemplated by the Chilean legal system to ensure the sustainable use of forest resources.
