Debate, problemáticas y efectos que derivan de la Ley de Identidad de Género e incertidumbre sobre la inclusión de menores de edad
Resumen
El artículo revisa la ley de identidad de género aprobada en Chile, cómo se desarrolló el debate de los temas más álgidos de la misma en el Congreso Nacional y cómo ha sido tratada la materia en el derecho comparado de la región. Posteriormente, se hará un análisis de la inclusión de los menores de edad y los requisitos que deben cumplir, las dificultades y riegos aparejados que puede generar un insuficiente reglamento sobre el acompañamiento a menores de catorce años y, finalmente, las aristas indirectas conexas con la ley que muestran su vulnerabilidad.
Abstract
The article reviews the gender identity approved in Chile, how did the discussion developed at the National Congress regarding the most critical issues and how has the subject been handled in the Comparative Law of the region. Afterwards an analysis of the inclusion of minors and the requirements they need to comply with, the possible difficulties and risks linked to an insufficient ruling for the accompaniment of children under 14 years and finally the related indirect aspects that the legislation was not looking for which show its vulnerability.
