El objeto de este trabajo corresponde a abordar el tratamiento indemnizatorio de eventos subjetivamente dañosos, vinculados a la existencia natural o legal de un ser humano. Comprendemos dentro de este espectro, tanto el cuestionable daño sufrido por quien quiso evitar un embarazo sin éxito en razón de una infracción a la lex artis; aquel que se identifica con la pérdida de la oportunidad de abortar, en caso de haber conocido la condición con la que venía el niño; como incluso aquel que tiene relación con la consideración de la vida misma (post nacimiento) como un daño. El estudio de estos temas se realizará desde la perspectiva de países exponentes del sistema anglosajón como del latino continental de responsabilidad civil. En particular, respecto de las acciones a través de las cuales puede ser demandada la indemnización. Nos referiremos, entonces, a las wrongful actions y, en particular, a la acción por wrongful conception, wrongful birth y wrongful life, de acuerdo con la terminología tradicional anglosajona Lo que para nosotros corresponde a decir “acción por concepción injusta”, “nacimiento injusto y vida injusta”.

The purpose of this paper is to address the compensatory treatment of subjectively harmful events, linked to the natural or legal existence of a human being. The study of these topics will be carried out from the perspective of countries that are exponents of the Anglo-Saxon system and of the Latin American continental civil liability.
