Teniendo presente el tema central de esta edición de la revista
Actualidad Jurídica, resulta procedente la incorporación de una materia que tiene una íntima relación con los derechos sociales de las personas y, en especial, lo referente a la institucionalización de las prestaciones que les permiten satisfacer todas las necesidades que se generan en los diferentes ámbitos de la vida y del quehacer ciudadano. Para cumplir con este objetivo, y no sin antes recordar el sustento básico de esta materia, se entrega una visión general del antiguo sistema de pensiones, por las razones que se indican, y del nuevo sistema previsional, los aspectos esenciales que deben conocerse para poder ejercer las acciones y derechos que del mismo emanan. Finalmente, es imprescindible analizar las herramientas que a este último han sido incorporadas, con el objetivo que los beneficiarios tengan un acceso directo y efectivo a las prestaciones que son consecuencias de las modificaciones introducidas al sistema, a partir de la dictación de la ley No 20.255 de 2008 y mediante dichas herramientas, ejercer el derecho de opinión y participación.

Bearing in mind the central theme of this edition of the Journal Actualidad Jurídica, it is appropriate to incorporate a subject that has an intimate relationship with the social rights of people and, especially, the institutionalization of benefits that allow them to satisfy all the needs that are generated in the different areas of life and citizenship. To fulfill this objective, and not without first remembering the basic sustenance of this matter, a general view of the old pension system is given, for the reasons indicated, and the new pension system, the essential aspects that must be known in order to be able to exercise the actions and rights that emanate from it. Finally, it is essential to analyze the tools that have been incorporated to the latter, with the objective that the beneficiaries have direct and effective access to the benefits that are consequences of the modifications introduced to the
system, starting from the enactment of Law 20,255 of 2008 and through these tools, exercise the right to opinion and participation.
