Sobre las diferentes acciones de protección de la propiedad en el derecho chileno

El trabajo examina, desde una perspectiva histórica, la evolución de las acciones que el derecho chileno ofrece para la protección de la propiedad. Junto a la acción reivindicatoria, única prevista en su origen por el Código Civil y cuyo alcance ha sido redefinido por la jurisprudencia a propósito de la teoría de la posesión inscrita; se revisan la acción de precario, construida por los tribunales sobre el inciso segundo del art. 2195; la acción meramente declarativa o de certeza de dominio; la acción innominada de restitución y la acción constitucional de protección. Se destaca el papel central de la jurisprudencia, con apoyo de la doctrina, en la creación y delimitación de estos remedios, así como las incertidumbres que subsisten mientras esas reglas terminan de asentarse.
Abstract
This paper examines, from a historical standpoint, the evolution of the actions available under Chilean law for the protection of ownership. Alongside the reivindicatory action, the only one originally provided by the Civil Code and whose scope has been redefined by case law in connection with the theory of registered possession, the paper reviews the precarium action, built by the courts upon the second paragraph of art. 2195; the merely declaratory action, or action for certainty of ownership; the innominate action for restitution; and the constitutional action for the protection of property. It underscores the central role of case law, supported by legal scholarship, in creating and shaping these remedies, as well as the uncertainties that remain while the rules thus formed become settled.
