Los bienes comunes en Chile: un debate abierto
Resumen
El presente artículo analiza la crisis de la noción de lo “común” en el ordenamiento jurídico chileno. A partir de una revisión histórica y filosófica, se examina cómo el concepto moderno de propiedad exclusiva ha actuado como un obstáculo para la integración de los bienes comunes. Se contrastan las visiones de la “tragedia” de Garrett Hardin con la gobernanza policéntrica de Elinor Ostrom y la “comedia” de Carol Rose. Finalmente, se propone la construcción de un régimen de base que supere la bipolaridad publicatio/apropriatio, reconociendo la función social de la propiedad y el derecho al acceso frente a la lógica de la exclusión.
Abstract
This article analyzes the crisis surrounding the notion of the “commons” in the Chilean legal system. Drawing on a historical and philosophical review, it examines how the modern concept of exclusive property has acted as an obstacle to the integration of common goods. Garrett Hardin’s vision of the “tragedy” is contrasted with Elinor Ostrom’s polycentric governance and Carol Rose’s “comedy”. Finally, the article proposes the construction of a foundational regime that overcomes the publicatio/apropriatio dichotomy, recognizing the social function of property and the right of access in the face of the logic of exclusion.
